Terms of Service
Effective date: July 17, 2026 · These terms may be updated as our legal review completes; material changes will be announced in-app.
1. Agreement
These Terms of Service ("Terms") are an agreement between you and NextTier Careers, the operator of NPivot (the "Service"), available at app.npivot.com. By creating an account, setting a password, joining a team, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
NPivot provides healthcare provider and facility intelligence assembled from public and licensed data sources, including data published by the Centers for Medicare & Medicaid Services (CMS), the National Plan & Provider Enumeration System (NPPES), the Health Resources & Services Administration (HRSA), and other public sources. NPivot is not affiliated with, endorsed by, or sponsored by CMS, HRSA, or any government agency.
3. Accounts and teams
- You are responsible for safeguarding your credentials and for all activity under your account.
- An account owner may invite team members. The owner's plan and quotas are shared across the team, and the owner is responsible for their team members' use of the Service.
- Team members joining an account accept these Terms when they set their password.
4. Subscriptions and billing
- Paid plans are billed through our payment processor (Chargebee). By subscribing you authorize recurring charges at the listed price until you cancel.
- Plans renew automatically monthly or annually. You can upgrade, downgrade, or cancel anytime from the billing portal; changes take effect per the portal's proration rules.
- Trials convert or expire as described at signup. Quotas (records, searches) reset each calendar month and do not roll over.
5. Acceptable use
You agree NOT to:
- Resell, redistribute, sublicense, or publish data obtained from the Service, in bulk or as a substitute for the Service, outside your organization's internal business use.
- Use the Service or its data to attempt to re-identify individuals from de-identified or aggregate data.
- Scrape, harvest, or access the Service by any automated means other than interfaces we provide, or circumvent quotas, plan gates, or security controls.
- Use contact information obtained through the Service in violation of applicable law. You are solely responsible for your outreach complying with all applicable communications laws — including TCPA, CAN-SPAM, and state equivalents. The Service provides business contact data from public sources; it does not screen numbers or addresses against do-not-call or suppression lists.
- Share seats outside your organization or operate an account on behalf of an undisclosed third party.
We may suspend or terminate accounts that violate this section.
6. Data; no warranty of accuracy
Data in the Service originates from third-party and government sources that update on their own schedules and contain their own errors. The Service is provided "as is" without warranties of any kind, including accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose. The Service is not a Consumer Reporting Agency, and its data must not be used for credentialing, employment eligibility, credit, insurance, or any purpose regulated by the FCRA.
7. Intellectual property
We retain all rights in the Service, its software, and its compilations. You retain rights in materials you upload. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription for your internal business purposes.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data.
9. Termination
You may cancel at any time. We may suspend or terminate the Service for breach of these Terms. Sections 5–8 survive termination.
10. Changes; contact
We may update these Terms; material changes will be announced in-app or by email, and continued use after the effective date constitutes acceptance. Questions: support@npivot.com.
